PLEASE READ THESE TERMS OF SERVICE CAREFULLY. This is a binding legal agreement between you ("User," "you," or "your") and KYMJOJOBS ("Kymjojobs," "we," "us," or "our") that governs your use of the Kymjojobs platform.
1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement governing your access to and use of the website located at https://kymjojobs.com/, and all associated platforms, including any content, functionality, and services offered (collectively, the "Service"). By creating an account, accessing the website, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other supplemental policies referenced herein. If you do not agree with any part of these Terms, you are prohibited from using the Service.
2. Description of the Service
Kymjojobs is a comprehensive digital ecosystem providing a range of services designed for the Nigerian market. Our Service includes, but is not limited to:
- A Job Board connecting Job Seekers with Employers, featuring a secure Employer Portal for applicant management.
- A public Hire Workers Form allowing businesses to submit job vacancies for publication on our platform.
- A premium Intelligent Job Alerts subscription service.
- A VTU & Data Hub for purchasing digital services like airtime, data bundles, and paying utility bills via a personal digital wallet.
- An E-commerce Marketplace where verified Sellers can list products and services for sale to Buyers.
- An Agent Program that allows approved members to earn commissions.
- An Advertising Platform for businesses to display targeted ads.
3. User Accounts, Eligibility, and Verification
3.1 Eligibility: To use the Service, you must be at least 18 years old and capable of entering into a binding contract. By creating an account, you represent and warrant that you meet these eligibility requirements.
3.2 Account Registration: You agree to provide true, accurate, current, and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You must notify us immediately of any suspected unauthorized use of your account.
3.3 Profile and Data Verification: To maintain the integrity and safety of our platform, certain user activities (such as updating a Jobseeker profile or becoming a Marketplace Seller) require the submission of information and/or documents for review. All such submissions are subject to our internal approval process. We reserve the right, at our sole discretion, to approve, reject, or request modifications to any submitted content. Your profile updates will not be made public until they have been approved. We may also require identity or business verification documents, which will be handled in accordance with our Privacy Policy.
4. User Content and Conduct
4.1 User Content Responsibility: You are solely responsible for all data, text, images, and other materials that you post, upload, or otherwise transmit via the Service ("User Content"). This includes the accuracy and legality of job descriptions, profile information, marketplace listings, and chat messages.
4.2 License to User Content: By submitting User Content, you grant Kymjojobs a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with providing and promoting the Service.
4.3 Prohibited Conduct: You agree not to use the Service to:
- Post content that is unlawful, fraudulent, defamatory, hateful, or discriminatory.
- Infringe upon any third party's intellectual property rights, including copyright, trademark, or patent.
- Circumvent the platform's intended communication or payment channels by sharing personal contact information (phone numbers, email addresses, social media links) in public listings, profiles, or initial chat messages to conduct transactions externally.
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Engage in any form of spamming, data mining, or scraping.
- Introduce viruses, trojan horses, worms, or other material that is malicious or technologically harmful.
5. Service-Specific Terms
5.1 Career Services (Job Seekers & Employers)
Employers are solely responsible for their job postings and hiring practices. Kymjojobs is not an employer and is not responsible for any employment decisions. Access to the secure Employer Portal is provided via a unique, confidential link. Employers agree to pay all applicable fees for premium services, such as unlocking applicant details or boosting listings. Job Seekers acknowledge that applying for a job does not guarantee an interview or employment.
5.2 Hire Workers Form
The Hire Workers Form allows both registered and non-registered users (guests) to submit job vacancies for potential publication on our platform. All submissions are subject to review by our administrative team and we reserve the right to approve, edit for clarity, or reject any submission at our sole discretion. To prevent spam, submissions are rate-limited to one per user or IP address within a 24-hour period.
5.3 Marketplace (Sellers & Buyers)
Kymjojobs provides a venue for Sellers to list items and for Buyers to purchase them. We are not a party to the transaction between Buyer and Seller. Sellers are responsible for the accuracy of their listings, the quality of their products/services, and timely fulfillment of orders. Buyers are responsible for reading the item description and asking questions before making a purchase. All communication regarding custom services must be conducted through the provided on-site chat system until a formal order is placed. Kymjojobs will deduct a commission from the final sale price of all completed orders, as specified in our seller policies.
5.4 VTU & Data Hub
The Digital Wallet is a closed-loop system for purchasing services available exclusively on Kymjojobs. Funds added to your wallet are not legal tender, cannot be withdrawn as cash, and are non-refundable except as required by law. The successful delivery of VTU services (data, airtime, etc.) is dependent on third-party telecommunication and utility providers. While we strive for instant delivery, we are not liable for delays or failures caused by these external providers.
5.5 Agent Program
Participation in the Agent Program is a privilege, not a right, and is subject to admin approval. Approved Agents can earn commissions on qualifying transactions made by their referred users. Commission rates and payout terms are defined on the Agent Dashboard and are subject to change at our discretion. Payouts are subject to a minimum withdrawal threshold and will be processed according to our official schedule.
6. Payments, Commissions, and Payouts
6.1 Fees: We reserve the right to charge fees for using certain features of the Service (e.g., Job Alerts, listing boosts, wallet funding). All applicable fees will be clearly disclosed to you prior to you completing a transaction.
6.2 Marketplace Commission: For each completed sale on the Marketplace, Kymjojobs will deduct a service commission from the total transaction amount paid by the Buyer. The remaining balance will be credited to the Seller's earnings balance.
6.3 Payouts: Payouts of accumulated earnings for Marketplace Sellers and Agents are made to a verified Nigerian bank account. You are responsible for providing and maintaining accurate bank details. Payouts are processed according to the schedule outlined in your respective dashboard and may be subject to minimum withdrawal amounts. We are not responsible for delays or losses caused by incorrect bank information provided by you.
7. Dispute Resolution
For disputes between a Buyer and a Seller on the Marketplace, we encourage parties to first communicate directly through our chat system to seek a resolution. If a resolution cannot be reached, you may contact our support team. While we may assist in mediating, Kymjojobs is not obligated to resolve disputes and all resolutions are at our sole discretion. We do not provide refunds on behalf of Sellers.
8. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. KYMJOJOBS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
KYMJOJOBS IS NOT RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE SERVICE. WE ARE NOT LIABLE FOR ANY DEALS, AGREEMENTS, OR DISPUTES BETWEEN USERS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KYMJOJOBS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
9. Termination
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms. Provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. General Provisions
10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
10.2 Entire Agreement: These Terms constitute the entire agreement between you and Kymjojobs concerning the Service and supersede all prior agreements.
10.3 Changes to Terms: We may modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
